Fitbit Sued In Australia For Misleading Consumers!

Google Fitbit will have to appear in court, according to recent news. According to the news, Australia’s competition watchdog announced on Monday that it had brought a lawsuit against Google Fitbit LLC.

The watchdog charges Google Fitbit with providing consumers with fraudulent or deceptive warranties on broken or defective products.

As a result, they frequently transgress one or more standards. Fitbit LLC is being sued by Australia’s competition watchdog for allegedly deceiving customers about their warranty rights for defective products, the company announced on Monday.

There is no change to the Statement of Rights. It doesn’t matter if the product is flawed or not. According to the Australian Competition and Consumer Commission (ACCC), Google Fitbit claimed that customers would not be eligible for a refund between May 2020 and February 2022.

Only if the faulty item is returned within 45 days of purchase or shipment will it be eligible for reimbursement. The Australian Consumer Law is not being followed in this case. The agency claims that a 45-day return period is not included in Australia’s Consumer Law.

It’s not the first time the ACCC has targeted Fitbit; in 2018, the fitness firm received a court-enforceable undertaking for violating similar regulations by making false claims about product warranties.

Additionally, the date of the product’s purchase is not relevant to a consumer’s claim for a replacement for a defective item. Additionally, there are several other Google Fitbit requirements that ACCC protests.

Fitbit informs customers that once a defective device has been replaced, there won’t be any further replacements, according to ACCC. This would largely be the case if the original Fitbit’s two-year “limited warranty” had ended.

Refunds were given if a defective Fitbit was returned within 45 days after purchase, and if the warranty had expired, customers were not eligible for a second replacement. In 2018, Fitbit went to court for violating similar warranty laws.

Automatic consumer warranty rights are rights that cannot be omitted, reduced, or amended for any consumer. Consumer warranty rights exist in addition to any manufacturer guarantees, according to Gina Cass-Gottlieb, chair of the ACCC.

There isn’t currently an official statement from Google Fitbit regarding this problem. The ACCC is suing Google Fitbit and asking for fines and restraining orders. When customers complained to Fitbit about issues with their devices.

The ACCC has no less than 58 incidents where it is claimed that Fitbit deceived customers.
