That’s why the third key element every landlord should include in a tenant application form is the applicant’s rental history. An applicant’s past residence history is one of the best indicators of what kind of tenant they will be. As the saying goes, “past performance is no indication of future performance,” but in the realm of tenant screening, this is rarely the case. A tenant’s past behavior often provides a reliable window into their future actions.

A comprehensive rental history section should include details of the applicant’s previous addresses, durations of stay, and landlord references. It’s also crucial to ask about any eviction history. This information aids landlords in assessing an applicant’s track record as a renter.

By contacting the previous landlord, you can verify the information provided by the applicant and garner additional insights into their reliability as a tenant. However, ensure that you’re speaking with the actual landlord, not a friend or relative posing as one. 

Criminal Background and Legal History

Having a deep understanding of a tenant’s past legal and criminal records is a vital component of the tenant screening process. 

Typically, this section of the form would ask applicants to disclose any criminal convictions, particularly those relating to property damage, violent behavior, or drug-related offenses. These kinds of convictions can directly impact the safety of the property and its residents.

Applicants should also be asked if they have any pending legal issues, such as ongoing lawsuits or disputes. This information helps us gauge the potential legal complications the applicant might bring to the tenancy.

While collecting this information, it’s crucial to abide by fair housing laws to avoid discrimination based on protected characteristics such as race, religion, or national origin.

The information gathered in this section serves as a crucial tool for making informed decisions about tenant suitability and property safety. It’s not about discriminating against individuals with a criminal or legal history, but about assessing the potential risks and ensuring a safe and secure living environment for all tenants.

For example, a history of property damage can indicate a potential risk to the property, while convictions related to violent or disruptive behavior could pose a risk to other tenants. It’s essential to evaluate this information objectively and within the context of each individual case.

Authorization and Signature

Landlords rely on tenant application forms to gather valuable information about prospective tenants. But without the tenant’s explicit permission, they can’t proceed with the application process. 

The “Authorization and Signature” section is crucial in two ways. First, it gives landlords the legal consent needed to conduct various background checks, such as credit checks, criminal history checks, and rental history verifications.

Second, it signifies the applicant’s acceptance of the terms and conditions outlined in the application form, transforming it from a mere form into a legally binding document.

The authorization and signature section should include clear language that allows the landlord to conduct background checks. It should also contain an agreement to terms section, whereby applicants read and agree to the terms and conditions of the rental application form. This could cover topics such as the application fee, the lease agreement, and the landlord’s policies and procedures.

Additionally, the section should include a declaration of accuracy, where the applicant confirms the truthfulness of the information provided. Finally, it should contain an acknowledgment of responsibility for any fees or charges associated with the application process.
